ORDINANCE O-5-18
Code of the Town of Cheverly
 
An Ordinance whereby the Mayor and Council update the housing code section regarding revocation or denial of license.
 
  • WHEREAS, Article VII, Sections C-23A(14) and (19) of the Charter of the Town of Cheverly grants to the Mayor and Town Council the power to prevent nuisances and protect the public health and welfare; and
  • WHEREAS, the Mayor and Town Council are cognizant that inspections of rental units directly affect the safety, health and well being of residents; and
  • WHEREAS, the Mayor and Town Council deem it appropriate to clarify that the Town requirements for inspections as part of the rental housing requirements must comply with the county and the state requirements in order to appropriately protect the public.
  • NOW, THEREFORE, BE IT ORDAINED by the Mayor and Town Council, in regular session assembled, that Sections 5-2(h)(5) of Chapter 5 of the Cheverly Code be amended as follows:
Chapter 5-4 LICENSING AND INSPECTION OF RENTALS

§  5-4(e)  License renewal.  A license may be revoked or denied by the town administrator if the owner, after ten (10) days’ notice from the town, fails to eliminate or to initiate good faith efforts to eliminate violations of the housing code.  Revocation or denial of a license shall be in addition to, and not in substitution for, such other penalties as may be provided for said violations elsewhere in this Code.  A LICENSE MAY BE REVOKED OR DENIED BY THE TOWN ADMINISTRATOR IF THE HOMEOWNER OR AGENT FAILS TO APPEAR FOR THREE (3) RENTAL INSPECTIONS OR FAILS TO SCHEDULE A RENTAL INSPECTION BY DECEMBER 1ST OF THE FISCAL YEAR.

  • AND BE IT FURTHER ORDAINED that if any provision of this Ordinance or the application thereof to any person or circumstance is held invalid for any reason, such invalidity shall not affect the other provisions or any other applications of the Ordinance which can be given effect without the invalid provision or applications, and to this end, all the provisions of this Ordinance are hereby declared to be severable.
  • AND BE IT FURTHER ORDAINED that this Ordinance shall take effect thirty (30) days from the date of its adoption; provided, however that a fair summary of the Ordinance is published at least once in a newspaper of general circulation in the Town of Cheverly.
  • INTRODUCED by the Mayor and Town Council of the Town of Cheverly, Maryland, at a regular meeting on August 9, 2018, at which meeting copies were available to the public for inspection.
  • ADOPTED by the Mayor and Town Council of the Town of Cheverly, Maryland, at a regular meeting on September 13, 2018, at which meeting copies were available to the public for inspection.
