ANNEXATION RESOLUTION
 
A Resolution of the Mayor and Council of the Town of Cheverly, Maryland
enlarging the corporate boundaries of the Town of Cheverly by annexing land contiguous and adjoining the existing corporate area of The Town of Cheverly, which land is described as Lot 4, block 8 in a subdivision known as Landover Park, also known as 6455 Old Landover Road.
 
  • WHEREAS, Lot 4, Block 8 of the Landover Park Subdivision as described in Exhibit A to this Resolution is entirely owned in fee by the Landover DK, LLC and there are no residents of this premises; and
  • WHEREAS, Landover DK, LLC has signed an Annexation Agreement (Exhibit B) in which Landover DK, LLC consents to have Lot 4 block 8 of a Landover Park subdivision annexed into the Town; and
  • WHEREAS, the Mayor and Town Council of the Town of Cheverly, Maryland have consented to and determined to initiate a Resolution to enlarge and extend the limits of the Town of Cheverly to include the hereafter described area and to make applicable to that area all laws which are now in force or may be hereinafter enacted; and
  • WHEREAS, the Town Administrator of the Town of Cheverly, Maryland has caused a public notice to be published no fewer than two (2) times, at not less than weekly intervals in a newspaper having a general circulation in the Town of Cheverly and the area to be annexed, briefly and accurately describing the proposed change and the conditions and circumstances applicable thereto. The public notice should further specify that a public hearing will be held on this Resolution by the Mayor and Town Council of Cheverly, Maryland at 8:00 o'clock P.M. in the Community Center building, 6401 Forest Road, Cheverly, Maryland, 20785, on Thursday, September 8, 2011; and
  • WHEREAS, such hearing was held as scheduled; and
  • WHEREAS, the Mayor and Town Council deem it appropriate to annex said contiguous property into the Town.
  • NOW, THEREFORE, BE IT RESOLVED by the Mayor and Town Council of Cheverly, Maryland in regular session assembled:
SECTION 1.  That there is hereby annexed to the territory of the Town of Cheverly, a municipal corporation, all of the land contiguous and adjoining to the existing Town of Cheverly in Prince George's County, Maryland, as described in Exhibit A, which is attached hereto and incorporated by reference.
 
SECTION 2.  That the Landover DK, LLC are the sole owners and have consented to this Annexation pursuant to the attached Annexation Agreement (Exhibit B) which is attached hereto and incorporated herein.
 
SECTION 3.   And Be it Further Resolved that the taxes as assessed in the Town of Cheverly against the property owners shall commence upon the effective date of the annexation.
 
SECTION 4.  And Be it Further Resolved that all the provisions of the Constitution of Maryland, all the laws of the State of Maryland applicable to the Town of Cheverly shall be and the same are hereby extended and made applicable to such portion of Prince George’s County as is, under the provisions of this Resolution, annexed to and made a part of the Town of Cheverly, Maryland.  Nothing herein or elsewhere in the Resolution shall affect the power of the Mayor and Town Council of Cheverly to amend or to repeal any charter revision or ordinance existing at the date of passage of this Resolution, or hereinafter, it may be authorized to enact or ordain.
 
SECTION 5.  And Be it Further Resolved that all the owners of the persons in the territory annexed to the Town of Cheverly by this Resolution and the property of said inhabitants shall, in all respects and to all intents and purposes, be subject to the powers, jurisdictions and authority vested, or to be vested by law, in the Mayor and Town Council of the Town of Cheverly, or which may hereinafter be enacted or ordained by it, so far as the same may be consistent with the provisions of this Resolution and the territory so annexed shall, in all respects, be taken and considered as part of the municipal corporation of the Town of Cheverly.
 
SECTION 6.  And Be it Further Resolved that this Resolution shall become effective forty-five (45) days from September 8, 2011, provided it is enacted by the Mayor and Town Council of Cheverly on that date and unless within the forty-five (45) days the Mayor and Town Council of Cheverly receive a petition for referendum in accordance with the provisions of Section 19 of Article 23A of the Annotated Code of Maryland (1957 Edition and Amendments).
 
SECTION 7.  And Be it Further Resolved that upon this resolution becoming effective the Town Administrator is hereby directed to send this resolution and the new boundaries of the Town to the Clerk of the Circuit Court for Prince George’s County, the Department of Legislative Reference and the Maryland National Capital Park and Planning Commission.
 
INTRODUCED by the Mayor and Town Council of the Town of Cheverly at a Regular Meeting on August 11, 2011, at which meeting copies were available to the public for inspection, and
 
PASSED by the Mayor and Town Council of the Town of Cheverly, Maryland, at a Regular Meeting on _________________, at which meeting copies were available to the public for inspection.
